Family and Medical Leave (Federal & State) & Medical Leave of Absence

If you are suffering a serious medical condition or are caring for your parent, child or spouse that is suffering a serious medical condition or you are having a baby or adopting, you may be eligible for FMLA / WFMLA / Medical LOA. A brief overview of the types of leaves are below; these are not all-encompassing and may be updated by the Federal or State Government at any time, as well as SDW Policy updates.

Family & Medical Leave Act (FMLA) Policy 3430.01, 4430.01, 1630.01 provides certain employees with up to 12 weeks of unpaid (SDW Policy states employees must use all available paid leave), job-protected leave per rolling calendar year who meet the eligibility requirements for their own serious health condition, the serious health condition of a parent, child or spouse and the birth or adoption of a child.

Wisconsin Family & Medical Leave Act (WFMLA) Policy 3430.01, 4430.01, 1630.01 provides certain employees with up to 2 weeks of unpaid, job-protected leave per calendar year, for those who meet the eligibility requirements for their own serious health condition, the serious health condition of a parent, child or spouse and up to 6 weeks for the birth or adoption of a child.

Medical Leave of Absence (Medical LOA) may be approved on a one by one basis, generally to those who are ineligible for FMLA or WFMLA, but would have been a qualifying reason under the FMLA or WFMLA.
